SIDEWALK, CURB, AND GUTTER PROGRAM

The City of Sandusky Sidewalk, Curb and Gutter Program is a citywide program intended to improve the safety and appearance of neighborhood streets and sidewalks. The Ohio Revised Code, Chapter 729, makes provisions for this program and places the responsibility on each property owner for the sidewalks and curbs abutting their property. More important however, is the fact that courts have held that property owners may be responsible for injuries to people who have fallen due to defective sidewalks.
The City of Sandusky performs a general inspection of the condition of sidewalks, curbs and gutters, and drive approaches. Affected property owners receive a notice including an estimate of the repairs to be made to their property. The property owner may engage a contractor of their choice, which is insured and bonded with the city, to do flat work repair. The contractor hired by the City through the bidding process completes the curb and gutter work.
Property owners are allowed 30 days from the receipt of their notice to have this work completed before the City will have the work performed by its contractor. This 30 days is required by law but may be extended if the City so chooses. If you wish to do the work yourself or have your own contractor perform this work, the work may be scheduled with the Department of Engineering Services and will be permitted provided it does not interfere with the progress of the City’s contractor.
Additionally, any citizen who wishes to construct, repair or replace any new or existing sidewalk, drive approach, curb, or similar work within the right-of-way adjacent to their property may choose to have the work completed by the Contractor hired by the City. The same billing and assessment process is followed as the Sidewalk Program, the property owner only needs to sign a waiver giving consent to the City to complete the work.
Following completion of the work by the City, invoices are mailed to the property owners based on the dimensions of actual work completed, interest, advertising cost, legal fees, and inspection cost. These invoices are usually mailed in January following the completion of the work. Upon receiving the invoice the property owner has a 30-day period to pay it in full, pay a portion of it, or none at all. At the end of the 30-day period any remaining balance will be transferred to the property owners real estate taxes as an assessment to be paid over a ten-year period.
The programs for 2003, 2004 and 2005 consisted of repairing partially compliant and/or non-compliant ramps constructed since 1992.
